Terms and Conditions of Use

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Nollywood CV Limited, the company that owns and operates NollywoodCV.com ("the Platform", "we", "us", or "our"). By accessing or using NollywoodCV.com in any manner, you confirm that you have read, understood, and agree to be fully bound by these Terms. If you do not agree to any part of these Terms, you must immediately discontinue your use of the Platform.
These Terms are governed by and shall be construed in accordance with the laws of the Federal Republic of Nigeria, including but not limited to the Nigeria Data Protection Act (NDPA) 2023, the NDPC General Application and Implementation Directive (GAID) 2025, the Cybercrimes (Prohibition, Prevention, Etc.) Amendment Act 2024, the Copyright Act 2022, the Federal Competition and Consumer Protection Act (FCCPA) 2018, the Companies and Allied Matters Act (CAMA) 2020, and the Arbitration and Mediation Act (AMA) 2023.
1. Acceptance of Terms
By creating an account, accessing, browsing, or using any feature of NollywoodCV.com, you unconditionally accept these Terms in full. This acceptance is effective from the moment of your first access to the Platform. If you are using the Platform on behalf of a company, organisation, or any other legal entity, you represent that you have full authority to bind such entity to these Terms.
Nollywood CV Limited reserves the right to modify, update, or replace these Terms at any time without prior notice. Updated Terms will be published on the Platform with a revised "Last Updated" date. Your continued use of the Platform after such changes constitutes your binding acceptance of the revised Terms. It is your sole responsibility to review these Terms periodically.
2. User Eligibility
You must be at least 13 years of age to use this Platform. If you are under 18 years of age, you confirm that you have obtained verifiable parental or guardian consent before using NollywoodCV.com, and that your parent or guardian has agreed to these Terms on your behalf.
By creating an account, you represent and warrant that:
- All registration information you submit is truthful, accurate, current, and complete.
- You will maintain the accuracy of such information at all times.
- You are legally permitted to use the Platform in your jurisdiction.
- Your use of the Platform does not violate any applicable law or regulation.
Nollywood CV Limited reserves the right to refuse access, suspend, or permanently terminate any account where eligibility requirements are not satisfied, without notice and without liability.
3. Intellectual Property and Content Ownership
3.1 Platform Intellectual Property
All content on NollywoodCV.com, including but not limited to its design, layout, graphics, logos, source code, software, databases, compiled data, methodologies, user interface, and any proprietary processes (collectively, "Platform Content") is the exclusive property of Nollywood CV Limited or its licensors. All rights are reserved.
Nothing in these Terms shall be construed as transferring any ownership rights in the Platform Content to you. You are strictly prohibited from copying, reproducing, adapting, modifying, distributing, transmitting, displaying, publishing, creating derivative works from, or commercially exploiting any Platform Content without the express prior written consent of Nollywood CV Limited.
The NollywoodCV.com name, logo, and brand identity are trademarks of Nollywood CV Limited. Unauthorised use of any trademark, trade name, or service mark displayed on the Platform is strictly prohibited and may constitute an infringement actionable under Nigerian law, including the Copyright Act 2022.
3.2 User-Submitted Content
You retain ownership of any content you upload, submit, or otherwise make available on the Platform ("User Content"), including images, videos, audio recordings, written materials, and CV information. However, by submitting any User Content to NollywoodCV.com, you grant Nollywood CV Limited a perpetual, irrevocable, worldwide, royalty-free, sub-licensable, non-exclusive licence to use, reproduce, edit, adapt, publish, translate, distribute, publicly perform, publicly display, and create derivative works from your User Content for any purpose, including but not limited to:
- Platform operation and improvement.
- Marketing, promotional, and advertising materials across all media formats, including social media, newsletters, television, radio, digital advertising, and print.
- Business development and investor presentations.
- Archival, research, and analytics purposes.
This licence continues even if you deactivate or delete your account, to the extent that your content has been shared with third parties or incorporated into Platform records prior to such deactivation.
You warrant that you own or have all necessary rights, licences, and consents to grant the above licence, and that your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party under Nigerian or international law.
4. Prohibited Conduct
You agree that you shall not, under any circumstances:
- Upload, post, or transmit any content that is defamatory, obscene, fraudulent, threatening, harassing, hateful, discriminatory, or otherwise unlawful under Nigerian law.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Submit false, inaccurate, misleading, or fabricated professional credentials, casting history, or biographical information.
- Use the Platform for solicitation, spam, unsolicited commercial messaging, or any form of fraudulent communication.
- Collect, harvest, or compile personal data about other users without their explicit consent, in violation of the NDPA 2023 and the GAID 2025.
- Interfere with, disrupt, or attempt to gain unauthorised access to the Platform's systems, servers, or databases.
- Use automated scripts, bots, scrapers, or other automated means to access, copy, or interact with the Platform.
- Upload or transmit malware, viruses, or any code designed to damage, intercept, or interfere with any system or data, contrary to the Cybercrimes (Prohibition, Prevention, Etc.) Amendment Act 2024.
- Use the Platform to facilitate human trafficking, exploitation, or any activity that endangers the safety or dignity of any person.
- Engage in any conduct that constitutes an abuse of a dominant position or anti-competitive behaviour contrary to the Federal Competition and Consumer Protection Act (FCCPA) 2018.
Violations of this clause may result in immediate account termination, reporting to the relevant law enforcement authorities or regulatory bodies, and civil or criminal liability under applicable Nigerian law.
5. Account Responsibilities
You are solely responsible for maintaining the security and confidentiality of your account login credentials. You must not share your password with any third party or permit any third party to access your account.
You must notify Nollywood CV Limited immediately at hello@nollywoodcv.com if you suspect or become aware of any unauthorised access to or use of your account. Nollywood CV Limited will not be liable for any loss or damage arising from your failure to comply with this obligation.
Any activity conducted through your account is your sole responsibility, whether or not you authorised such activity. Nollywood CV Limited reserves the right to treat all activity on your account as having been conducted by you.
6. Data Protection and Privacy
Nollywood CV Limited collects, stores, and processes personal data in accordance with the Nigeria Data Protection Act (NDPA) 2023 and the NDPC General Application and Implementation Directive (GAID) 2025, which together constitute the complete governing framework for data protection in Nigeria as of the date of these Terms. By using the Platform, you consent to the collection and processing of your personal data as described in our Privacy Policy, which forms part of these Terms.
Your personal contact details will not be sold, transferred, or disclosed to any third party without your explicit consent, except where required by law, by order of a Federal High Court of Nigeria, or by lawful directive from a government authority or regulatory body.
You have the right to request access to, correction of, or deletion of your personal data held by Nollywood CV Limited. Requests must be submitted to hello@nollywoodcv.com. Nollywood CV Limited will respond within the timeframes prescribed under the NDPA 2023 and the GAID 2025.
Where Nollywood CV Limited engages third-party data processors to support Platform operations, all such processors are required to comply with the NDPA 2023 and the GAID 2025. Nollywood CV Limited shall remain liable as a data controller for the conduct of any processors acting on its behalf.
In the event of a data breach that is likely to result in a risk to your rights and freedoms, Nollywood CV Limited will notify the Nigeria Data Protection Commission (NDPC) and affected users within the timeframes prescribed by Nigerian law.
7. Third-Party Interactions and Casting Engagements
NollywoodCV.com is a connecting platform. Any interaction, engagement, contract, negotiation, or dispute between a User and a third party (including but not limited to directors, producers, casting agents, studios, or production companies) is solely between the User and that third party.
Nollywood CV Limited does not guarantee, endorse, or verify the legitimacy, intentions, or identity of any third party that accesses User profiles. You engage with third parties entirely at your own risk.
Nollywood CV Limited shall bear no liability for any loss, damage, exploitation, fraud, breach of contract, physical harm, or any other consequence arising from interactions between Users and third parties facilitated or discovered through the Platform.
8. Limitation of Liability and Disclaimer of Warranties
To the fullest extent permitted by the laws of the Federal Republic of Nigeria:
- NollywoodCV.com is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
- Nollywood CV Limited makes no warranty that the Platform will be uninterrupted, error-free, secure, or free of viruses or harmful components.
- Nollywood CV Limited does not guarantee that any User will receive job placements, audition opportunities, or commercial engagements as a result of using the Platform.
- Nollywood CV Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of opportunity, reputational damage, or emotional distress, arising from your use of or inability to use the Platform.
- Nollywood CV Limited shall not be liable for any third-party misuse, reproduction, or commercial exploitation of publicly visible User Content.
Nothing in these Terms excludes or limits liability where such exclusion is prohibited by mandatory provisions of Nigerian law, including the Federal Competition and Consumer Protection Act 2018.
9. Indemnification
You agree to fully indemnify, defend, and hold harmless Nollywood CV Limited, NollywoodCV.com, their officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of the Platform.
- Your User Content.
- Your breach of any provision of these Terms.
- Your violation of any applicable Nigerian law or the rights of any third party.
- Any dispute between you and a third party facilitated through the Platform.
Nollywood CV Limited reserves the right to assume exclusive control of any matter for which you are required to indemnify us, and you agree to cooperate fully in such defence at your own cost.
10. Termination and Suspension
Nollywood CV Limited reserves the absolute right, at its sole discretion and without notice or liability, to:
- Suspend or permanently terminate your account for any breach of these Terms or for conduct deemed harmful to the Platform, its users, or its reputation.
- Remove any User Content that violates these Terms or that Nollywood CV Limited considers objectionable, at any time and without notice.
- Restrict access to the Platform or any of its features for operational, legal, or security reasons.
Upon termination, your right to use the Platform ceases immediately. Termination does not affect any rights or obligations accrued prior to the termination date. The licence granted to Nollywood CV Limited over your User Content shall survive termination to the extent described in Clause 3.2.
You may deactivate your account at any time by contacting us at hello@nollywoodcv.com. Deactivation does not constitute deletion of all data, which remains subject to our data retention policy as permitted under the NDPA 2023 and the GAID 2025.
11. Fees, Subscriptions, and Payments
Where NollywoodCV.com offers premium, paid, or subscription-based features, the applicable fees will be clearly disclosed at the point of purchase in compliance with the consumer transparency requirements of the Federal Competition and Consumer Protection Act (FCCPA) 2018. All payments are non-refundable except as expressly stated in a separate refund policy or where required by applicable Nigerian law.
Nollywood CV Limited reserves the right to introduce, modify, or discontinue any paid feature or subscription plan at any time. Where fees are changed for existing subscribers, reasonable advance notice will be provided.
You are responsible for any applicable taxes, levies, or charges under Nigerian law arising from transactions conducted through the Platform, including any applicable Value Added Tax (VAT) under the Finance Act 2020 (as amended).
12. Dispute Resolution
In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform, the parties shall first attempt to resolve the matter amicably through good-faith negotiations within thirty (30) days of written notice of the dispute submitted to hello@nollywoodcv.com.
If the dispute cannot be resolved through negotiation, it shall be submitted to mediation under the Arbitration and Mediation Act (AMA) 2023, in accordance with the National Policy on Arbitration and Alternative Dispute Resolution 2024-2028, with mediation to be conducted by a mutually agreed neutral mediator in Nigeria.
If mediation fails, the dispute shall be finally resolved by binding arbitration in Nigeria under the Arbitration and Mediation Act (AMA) 2023, with proceedings conducted in the English language. The decision of the arbitrator shall be final and binding on both parties and shall be enforceable in any court of competent jurisdiction in Nigeria.
Nothing in this clause prevents Nollywood CV Limited from seeking urgent injunctive or other equitable relief from a Federal High Court of Nigeria to protect its intellectual property, confidential information, or Platform integrity.
13. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed exclusively in accordance with the laws of the Federal Republic of Nigeria.
Subject to the dispute resolution provisions in Clause 12, both parties irrevocably submit to the exclusive jurisdiction of the Federal High Court of Nigeria for the resolution of any disputes that proceed to litigation, in recognition of the federal nature of Nollywood CV Limited's operations across Nigeria.
14. Force Majeure
Nollywood CV Limited shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, civil unrest, government action, internet outages, telecommunications failures, power failures, or any directive or order issued by a Nigerian regulatory authority.
15. Severability
If any provision of these Terms is found by a competent court or arbitral tribunal to be invalid, unlawful, or unenforceable under Nigerian law, that provision shall be modified to the minimum extent necessary to make it enforceable. The validity and enforceability of the remaining provisions shall not be affected.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and Nollywood CV Limited with respect to your use of NollywoodCV.com. They supersede all prior agreements, representations, or understandings, whether written or oral, relating to the subject matter herein.
17. No Waiver
The failure of Nollywood CV Limited to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision, unless acknowledged in writing by an authorised representative of Nollywood CV Limited.
